Alarmox Terms of Use

These Terms govern your use of the Alarmox iOS app provided by Wotaso GmbH. By using Alarmox, you agree to these Terms.

1. Provider

Alarmox is provided by Wotaso GmbH, Bostonring 5, 71686 Remseck am Neckar, Germany. Email: support@alarmox.com. Further legal details are available in the Alarmox imprint.

2. App Store Terms

Alarmox is distributed through Apple's App Store. Your app license is also subject to Apple's applicable App Store terms and Apple's standard Licensed Application End User License Agreement unless Apple or Wotaso provides a different agreement for Alarmox. Apple is not responsible for Alarmox's content, support, or claims except as required by Apple's terms or applicable law.

3. What Alarmox Does

Alarmox helps you set alarms and complete wake-up challenges such as camera-based object scans, voice-repeat challenges, walking challenges, grass scans, or push-up challenges. Some features may require iOS permissions, an internet connection, Apple's AlarmKit, anonymous app account state, or a paid subscription.

4. Important Alarm Limitations

Alarmox is a behavioral alarm aid, not a safety-critical system. iOS and Apple control key parts of alarm delivery, notifications, audio behavior, background execution, battery management, Focus modes, permissions, and system UI. A third-party app cannot guarantee an alarm that is impossible to bypass or that always fires in every circumstance.

Do not rely on Alarmox as your only alarm for medical needs, travel, work obligations, childcare, emergency response, medication, or any situation where missing an alarm could cause harm, legal consequences, or financial loss. You remain responsible for backup alarms and for checking that your device, volume, permissions, battery, network, and iOS settings are suitable.

5. Acceptable Use

Use Alarmox only for lawful personal purposes.
Do not misuse invite links, friend features, support channels, or analytics systems.
Do not attempt to reverse engineer, disrupt, overload, scrape, or bypass Alarmox services.
Do not upload, share, or send unlawful, harmful, abusive, or rights-infringing content.
Do not use Alarmox in a way that endangers yourself or others.

6. Friend Features and Sharing

Alarmox may let you create an emoji profile, invite friends, view friends' wake results, and share proof videos. Only share invite links and proof videos with people who should receive them. If you use the iOS share sheet, the selected third-party service is responsible for its own processing after sharing.

7. Subscriptions and Paid Features

Alarmox may offer paid features through auto-renewing subscriptions or other in-app purchases. Prices, trial periods, renewal terms, cancellation, refunds, and billing are shown in the App Store purchase flow and managed by Apple. You can manage or cancel subscriptions in your Apple ID subscription settings.

Paid access may depend on Apple and RevenueCat purchase validation. We may change feature packaging for future billing periods where permitted by law and App Store rules.

8. Availability and Changes

We may update, improve, suspend, or discontinue Alarmox features where reasonably necessary, for example for security, technical, legal, platform, or product reasons. We aim to keep Alarmox available, but we do not guarantee uninterrupted or error-free operation.

9. Privacy

The processing of personal data is explained in the Alarmox Privacy Policy.

10. Intellectual Property

Alarmox, including its software, design, text, graphics, trademarks, and other content, is owned by Wotaso GmbH or its licensors and is protected by applicable intellectual property laws. You receive only the right to use Alarmox as permitted by these Terms and the App Store terms.

11. Open Source

Alarmox includes open-source software. Applicable open-source license notices are available inside the app where supported by the current build. Those licenses apply to the relevant components and are not limited by these Terms.

12. Warranty Rights

If you are a consumer in the European Union, you have statutory rights for digital products and services. Nothing in these Terms limits mandatory consumer rights that cannot be waived by contract.

13. Liability

Wotaso GmbH is liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and where Wotaso has given an express guarantee.

For slight negligence, Wotaso GmbH is liable only for breach of essential contractual duties whose fulfilment makes proper use of Alarmox possible and on whose compliance you may regularly rely. In that case, liability is limited to typical and foreseeable damage. Any further liability for slight negligence is excluded to the extent permitted by law.

14. Termination

You may stop using Alarmox at any time and delete the app from your device. We may restrict or terminate access if you materially violate these Terms or if restriction is necessary for security, legal, or platform reasons. Subscription cancellation must be handled through Apple ID subscription settings.

15. Governing Law and Disputes

These Terms are governed by German law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of mandatory protections of the country in which you habitually reside.

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Wotaso GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
